NORDHUS TERMS OF SALE, DELIVERY, INSTALLATION AND RETURNS

Effective Date: July 26, 2026 Version 1.2 Last Updated: October 30, 2026

IMPORTANT: READ BEFORE PAYING. These Terms govern your purchase. They include a no-cancellation and no-return policy, limits on our liability, and your assumption of risk related to sauna use. By submitting payment, you agree to all of it.

1. PARTIES AND ACCEPTANCE

1.1 These Terms of Sale, Delivery, Installation and Returns (the “Terms”) form a binding agreement between Nordhus (“Nordhus,” “we,” “us,” or “our”) and the person or entity purchasing a sauna, related product, or installation service (“you,” “Customer,” or “Buyer”).

1.2 At online checkout, you must affirmatively select the required agreement checkbox before submitting payment. By doing so, you confirm that you have read and accept these Terms and the Sauna Use Acknowledgment, Assumption of Risk and Release provided at checkout. Acceptance may also be recorded on a signed order form or quote. The version presented and accepted for your order governs that order.

1.3 These Terms apply to consumer purchases for personal, family, or household use. Purchases for commercial, rental, club, gym, hospitality, short-term rental, or any other non-residential or revenue-generating use require a separate written commercial agreement with Nordhus. If you purchase under these Terms and then place the unit into commercial or short-term rental use, you do so at your own risk, and manufacturer warranty coverage may be reduced or voided.

1.4 These Terms replace any prior discussion, text message, email, proposal, or verbal statement. Nothing our sales staff says modifies these Terms unless we confirm it in writing signed by Nordhus.

2. DEFINITIONS

“Unit” means the sauna and any factory components supplied with it, including the heater and control system.

“Manufacturer” means the party that builds the Unit and the party that builds the heater. These may be different companies.

“Installation” means the optional service, purchased separately, in which Nordhus assembles the Unit at your Site. Nordhus does not perform or arrange any electrical work.

“Site” means the location where the Unit is delivered and, if applicable, installed.

“Delivery” means the arrival of the Unit at your Site by freight carrier.

3. QUOTES AND PRICING

3.1 Written quotes are valid for 30 calendar days from the date issued. After 30 days, pricing and availability must be re-confirmed.

3.2 Prices are in U.S. dollars and exclude sales and use tax, which is added at checkout or invoiced as required by law.

3.3 Delivery freight to the contiguous 48 United States is included in the Unit price. Delivery to Alaska, Hawaii, and any location outside the contiguous 48 states is quoted separately and is not included.

3.4 Installation is not included in the Unit price. Installation is offered case by case and is quoted separately. Installation pricing varies with geography, Site access, electrical scope, and other factors.

3.5 Once we accept your order and take payment, the price of that order is fixed. We will not add surcharges to an accepted order.

4. PAYMENT

4.1 Payment in full for the Unit is due before Nordhus places the order with the supplier. We do not order product against a deposit, a partial payment, or a promise to pay.

4.2 There is no deposit structure. The full amount you pay is a payment against a specific Unit built and shipped for you.

4.3 Installation fees are due either at the time of purchase or before Installation begins, at our election, and in all cases before our crew begins work.

4.4 We accept payment through our third-party payment processor. Nordhus does not directly offer financing, layaway, or payment plans. Any third-party financing option displayed at checkout is subject to that provider’s separate approval, terms, and agreement.

4.5 If a payment is reversed, charged back, or fails after we have ordered your Unit, you remain responsible for the full purchase price plus any costs we incur, including restocking, freight, storage, and reasonable collection and attorney fees.

5. ORDER ACCEPTANCE

5.1 Your payment is an offer to buy. The order is accepted when we send you a written order confirmation.

5.2 We may decline any order. If we decline before ordering from the supplier, we refund you in full. Reasons include product discontinuation, pricing errors, suspected fraud, and delivery locations we cannot serve.

5.3 Product images, dimensions, wood tone, and specifications are approximate. Wood is a natural material. Color, grain, and knot variation between the Unit you receive and any photograph is normal and is not a defect.

6. ALL SALES ARE FINAL

6.1 Each Unit is ordered, built, and shipped specifically for you. Accordingly, all sales are final. Once we place your order with the supplier, you may not cancel, and we do not issue refunds, credits, or exchanges.

6.2 NO RETURNS. We do not offer a voluntary return or exchange policy. We do not accept a Unit back because you changed your mind, moved, sold the property, could not obtain HOA or municipal approval, discovered the Unit does not fit, discovered your electrical service is inadequate, or no longer want it.

6.3 Confirming your Site measurements, clearances, access path, electrical capacity, and any HOA, covenant, permit, or local code requirement is your responsibility, and it is your responsibility before you pay. See Section 10.

6.4 Defective Units are handled through the Manufacturer warranty process described in Section 13, not by return or refund.

6.5 Exception for shipping delays. If we cannot ship your Unit within the time period stated in your order confirmation, or within 30 days of your payment if no time period was stated, we will notify you of the revised date and offer you the choice to consent to the delay or to cancel your order for a full refund. This right exists under federal law, and nothing in this Section 6 limits it. Once you consent to a revised date, Section 6.1 applies again.

7. LEAD TIMES AND SCHEDULING

7.1 We provide an estimated lead time in your order confirmation. Lead times depend on Manufacturer inventory and vary substantially by model. In-stock Units typically ship within days. Out-of-stock and made-to-order Units can take several weeks to several months.

7.2 Except as stated in Section 6.5, delivery and installation dates are estimates and are not guaranteed. Delay does not entitle you to cancel, to a refund, to a discount, or to damages of any kind.

7.3 We are not responsible for delays caused by the Manufacturer, freight carriers, weather, road closures, port or customs issues, labor disruption, supply shortages, or any other cause outside our reasonable control.

7.4 Do not schedule contractors, concrete work, events, rentals, or other commitments around an estimated date. We are not responsible for costs you incur by doing so.

8. DELIVERY

8.1 Units ship by freight carrier. Delivery is curbside or to the nearest safe point the truck can reach. The carrier is not responsible for moving the Unit onto your property, around your house, up stairs, across landscaping, or into a backyard.

8.2 An adult 18 or older must be present at the delivery address to receive and sign for the shipment. We do not deliver to unattended addresses under any circumstance.

8.3 The carrier will contact you to schedule a delivery appointment. It is your responsibility to be reachable and to keep the appointment.

8.4 Failed delivery. If no one is present at the scheduled appointment, or if the delivery cannot be completed because of your Site or access, you will be charged a re-delivery fee of $200 per attempt. Re-delivery fees must be paid before the next attempt is scheduled.

8.5 Access is your responsibility. You must confirm that the delivery truck can reach your address and that the drop point is usable. This includes road weight limits, low-clearance obstructions, narrow lanes, private drives, gated communities, steep or unpaved drives, and seasonal road conditions. If a specialized truck, lift gate, crane, or additional labor is required, that cost is yours.

8.6 Title and risk of loss pass to you upon Delivery. Once the Unit is delivered, it is yours, and you bear the risk of theft, weather damage, vandalism, and damage from moving it.

8.7 We cannot store or hold Units. If you are not ready to receive your Unit, you are still responsible for accepting Delivery on the scheduled date and for storing it yourself.

9. INSPECTION AND DAMAGE CLAIMS

9.1 Visible damage. Inspect the shipment before the driver leaves. Note any visible damage to the crating, packaging, or product on the delivery receipt before you sign it, and photograph it while the truck is still there. This is the single most important step in the process. Signing a clean delivery receipt makes a freight damage claim difficult or impossible to win, and if you sign clean, we may not be able to help you.

9.2 Concealed damage. Damage discovered after the driver leaves must be reported to Nordhus at hello@nordhussauna.com within 15 calendar days of Delivery. This window matches the deadline most freight carriers allow for concealed damage claims. We cannot pursue a carrier claim after their window closes.

9.3 Missing parts. If factory-supplied parts are missing from your shipment, report it to us within 30 calendar days of Delivery and we will arrange replacement parts at no cost to you.

9.4 What a claim requires. Clear photographs of the damaged item, the packaging, the crate, and the shipping label, plus a written description of the damage and your order number.

9.5 Preserve the evidence. Do not discard the crating, pallet, or packaging until the claim is resolved. Carriers routinely deny claims when the packaging is gone.

9.6 The Unit must remain unused and uninstalled while a freight damage claim is open. Installing or using a damaged Unit voids the claim.

9.7 Claims submitted after the windows in Sections 9.2 and 9.3 are waived. These deadlines are driven by the freight carriers, not by us.

9.8 Installation damage. If Nordhus performed the Installation and our crew damaged the Unit or your property during Installation, that is on us. Report it to us and we will repair or replace it. This is separate from the freight claim process and is not subject to the deadlines in Sections 9.2 and 9.3, though you must report it promptly.

10. YOUR RESPONSIBILITIES AT THE SITE

10.1 You are solely responsible for the Site and everything about it. This includes:

a. providing a level, stable, load-bearing, properly drained surface capable of supporting the Unit and its occupants;

b. all foundation, pad, gravel, footing, deck, and structural work;

c. drainage, grading, and water management around and under the Unit;

d. clearing the Site and the access path, including snow, ice, vegetation, furniture, and stored items;

e. maintaining a clear working area of at least 3 feet on every side of the Unit footprint during Installation;

f. confirming the Unit fits the intended space, including ceiling height and door swing;

g. confirming your electrical panel has adequate capacity and available breaker space for the Unit, using your own licensed electrician if needed;

h. confirming clearance from structures, fences, property lines, overhangs, gas meters, and combustibles as required by the Manufacturer instructions and local code;

i. obtaining any permit, inspection, HOA approval, covenant approval, landlord approval, or municipal approval that applies;

j. confirming any zoning, setback, or short-term rental restriction that applies to your property.

10.2 Nordhus does not perform, and expressly disclaims responsibility for, site preparation, foundations, pads, decks, framing, landscaping, grading, drainage, water management, permitting, inspections, and code compliance.

10.3 Nordhus does not pull permits and does not arrange inspections. If your jurisdiction requires either, that is your responsibility, and it is your responsibility to obtain it before we deliver or install.

10.4 We will place and install the Unit where you tell us to place it. We do not evaluate, approve, or warrant the suitability of the location you choose. Nordhus is not liable for any damage, loss, injury, code violation, fine, forced removal, or claim arising from the location you selected or the condition of the Site, including settling, shifting, water intrusion, rot, drainage failure, surface failure, or damage to your deck, patio, lawn, irrigation, or hardscape.

10.5 If our crew arrives and the Site is not ready as described above, we may reschedule at your cost, including a return trip charge quoted at the time.

11. INSTALLATION BY NORDHUS

11.1 Where you purchase Installation, our scope is limited to the following:

a. moving the Unit from the Delivery drop point to the prepared location you designate, where reasonably accessible;

b. assembling the Unit per the Manufacturer instructions;

c. a basic function check, only after the Customer’s licensed electrician has completed any required electrical work, and a walkthrough of operation. Nordhus does not energize or test an incomplete electrical installation.

11.2 Our scope expressly excludes:

a. any site preparation, foundation, pad, deck, or structural work;

b. pulling permits or scheduling inspections;

c. all electrical work, including wiring, hardwiring or connecting the heater, circuits, outlets, breakers, panel or service upgrades, subpanels, electrical testing, and trenching;

d. carpentry, roofing, siding, masonry, landscaping, irrigation modification, fence removal, or gate modification;

e. plumbing, gas work, and water supply or drainage work;

f. removal or disposal of existing structures;

g. crane, boom, or specialty lift services.

11.3 Any additional non-electrical services outside Section 11.1 require a separate written change order and additional payment before we perform them. Electrical work is not offered by Nordhus.

11.4 ALL ELECTRICAL WORK IS THE CUSTOMER’S RESPONSIBILITY. Nordhus does not perform, provide, arrange, or include any electrical work. You must hire, schedule, and pay an appropriately licensed electrician separately for all required electrical work, including preparing the supply cable, whip, or “tail” and making the final connection to the heater, including a 240V connection where applicable.

You and your electrician may choose one coordinated visit or separate visits. Nordhus does not require a particular number of electrician visits. Coordinate the electrician’s schedule with our assembly schedule so electrical preparation is ready when needed and final connection is completed after the heater is in position. The electrician must determine the circuit, cable, routing, protection, permits, testing, and inspection requirements from the specific heater’s Manufacturer instructions and applicable code. Unfinished wiring must remain safely isolated and secured by the electrician.

All electrician visits, electrical materials, permits, testing, and inspections are excluded from Nordhus’s Installation price. Nordhus does not connect the supply tail to the heater, perform electrical testing, certify or approve electrical work, or energize unfinished wiring. Do not use the heater until the electrician has completed all required work and approvals. A plug-in model must use the Manufacturer-specified electrical supply. If required electrical preparation is not ready, assembly or the operational walkthrough may need to be delayed or rescheduled as provided in Section 10.5.

11.5 We are not a general contractor and do not hold ourselves out as one. We do not provide engineering, architectural, or code-compliance services.

12. SELF-INSTALLATION BY CUSTOMER

12.1 You may install the Unit yourself or hire your own contractor instead of purchasing Installation from Nordhus.

12.2 If you do, you assume full and sole responsibility for the assembly, placement, electrical connection, code compliance, and safety of the Unit. Nordhus has no liability of any kind arising from an installation we did not perform.

12.3 All electrical connection must be performed by an electrician licensed in your jurisdiction. Traditional, hybrid, and outdoor models require a dedicated circuit. Do not attempt electrical work yourself.

12.4 You must follow the Manufacturer installation instructions exactly. Deviating from them will void your Manufacturer warranty and may create a fire, shock, or structural hazard.

12.5 You agree to indemnify, defend, and hold Nordhus harmless from any claim, damage, injury, loss, fine, or expense arising from an installation performed by you or by anyone other than Nordhus, including claims brought by household members, guests, tenants, neighbors, or subsequent property owners.

13. MANUFACTURER WARRANTY

13.1 Nordhus is an authorized reseller. The Unit and its heater are covered by the applicable Manufacturer limited warranty, not by a Nordhus warranty on the product.

13.2 Coverage typically includes, and is subject to, the written warranty documents supplied with your Unit:

a. 5 years on Unit parts and components;

b. lifetime coverage on infrared heating elements;

c. 3 years on traditional heaters supplied by HUUM;

d. for units supplied with a Harvia heater, the Harvia limited warranty in effect at the time of purchase, which is commonly 2 years with an additional year available on registered electric heaters.

13.3 The written warranty documents provided with your Unit control. If anything in this Section conflicts with those documents, those documents govern. Warranty terms are set by the Manufacturer and can change without notice to us.

13.4 Register your Unit and your heater with the Manufacturer promptly after Delivery. Some coverage requires registration.

13.5 Manufacturer warranties generally extend only to the original purchaser and do not transfer if you sell the Unit or the property.

13.6 Warranty claims. Contact Nordhus at hello@nordhussauna.com and we will help you open and pursue a claim with the Manufacturer. We will advocate for you. We do not control the outcome, the timeline, or the remedy the Manufacturer offers, and we are not liable for a Manufacturer’s denial, delay, or refusal to honor a claim.

13.7 A warranty claim does not entitle you to a refund from Nordhus, to cancel an order, or to withhold payment.

14. NORDHUS WORKMANSHIP WARRANTY

14.1 Where Nordhus performed the Installation, we warrant our own workmanship for 1 year from the date Installation is completed.

14.2 If our assembly workmanship fails within that period, we will correct it at no charge. This is your sole and exclusive remedy for defective workmanship.

14.3 This warranty covers our labor only. It does not cover the Unit, the heater, the electrical service at your property, the Site, or anything in Section 11.2.

14.4 This warranty is void if the Unit has been moved, modified, disassembled, repaired by anyone other than Nordhus, or damaged by Site conditions.

15. WHAT IS NOT COVERED

No warranty, whether from the Manufacturer or from Nordhus, covers the following:

a. normal wear, and normal weathering, checking, cracking, splitting, cupping, warping, and color change in natural wood;

b. failure to perform required maintenance, including sealing, staining, or treating exterior surfaces on the schedule the Manufacturer specifies;

c. water damage, including water intrusion, standing water, snow melt, sprinkler exposure, roof runoff, flooding, and poor drainage;

d. repairs, modifications, or alterations performed by you or by anyone not authorized by the Manufacturer;

e. improper installation, including any installation not performed by Nordhus;

f. improper electrical work, undersized circuits, inadequate service, voltage irregularity, power surge, and lightning;

g. misuse, abuse, neglect, and use inconsistent with the Manufacturer instructions;

h. exceeding rated temperature, session duration, or occupancy;

i. pouring water on heaters or components not designed for it, and pouring anything other than water and Manufacturer-approved sauna fragrance on the stones;

j. use of unapproved chemicals, cleaners, stains, sealants, oils, or fragrance products;

k. commercial, rental, short-term rental, club, gym, or any revenue-generating use of a residential Unit;

l. damage from moving or relocating the Unit after Installation;

m. damage from pests, rodents, insects, and mold or mildew resulting from ventilation or moisture conditions at your Site;

n. acts of nature, including wind, hail, flood, fire, earthquake, and falling trees or limbs;

o. cosmetic issues that do not affect function;

p. consumable and wear items, including stones, gaskets, bulbs, and finishes.

16. DISCLAIMER OF OTHER WARRANTIES

16.1 Except for the Manufacturer warranties described in Section 13 and the workmanship warranty in Section 14, the Unit and all services are provided “as is” to the fullest extent permitted by law.

16.2 Nordhus disclaims all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

16.3 Nordhus makes no representation or warranty regarding health outcomes. Statements about sauna benefits, whether made by us, the Manufacturer, or in published research, are general information and are not medical advice, not a diagnosis, and not a promise of any result.

16.4 Nordhus makes no representation or warranty that the Unit or its installation complies with your local building code, zoning ordinance, HOA covenant, insurance requirement, or short-term rental regulation.

16.5 Some states do not allow the exclusion of implied warranties, so parts of this Section may not apply to you. You may have other rights that vary by state.

17. HEALTH, SAFETY AND ASSUMPTION OF RISK

17.1 Sauna use involves extreme heat and carries real risk of injury and death, including heat exhaustion, heat stroke, dehydration, burns, fainting, falls, cardiac events, and drowning risk where cold immersion is used alongside sauna.

17.2 You must affirmatively accept the Nordhus Sauna Use Acknowledgment, Assumption of Risk and Release before payment at online checkout. For an offline purchase, it must be accepted in writing before Delivery or Installation, whichever comes first. That document is incorporated into these Terms and forms part of this agreement.

17.3 You agree to read the Manufacturer safety instructions and operating manual before first use, to follow them, and to make them available to every person who uses the Unit.

17.4 You are responsible for the safety of everyone who uses the Unit at your property, including household members, guests, minors, and any other person. You agree to supervise minors at all times and to prevent unsupervised access, including by using the lockout or child safety features available on your control system.

17.5 Consult a physician before using a sauna if you are pregnant or may be pregnant, or if you have any cardiovascular condition, blood pressure condition, respiratory condition, seizure disorder, diabetes, kidney disease, implanted medical device, recent surgery, acute illness, or any condition affected by heat, or if you take any medication that affects heart rate, blood pressure, hydration, sweating, or heat tolerance.

17.6 Never use a sauna while under the influence of alcohol, cannabis, recreational drugs, or any substance impairing judgment, heat tolerance, or consciousness.

18. LIMITATION OF LIABILITY

18.1 To the fullest extent permitted by law, the total aggregate liability of Nordhus arising out of or relating to your purchase, the Unit, its Delivery, its Installation, or these Terms, under any theory including contract, warranty, negligence, strict liability, or statute, will not exceed the amount you actually paid to Nordhus for the Unit and the Installation.

18.2 To the fullest extent permitted by law, Nordhus is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost rental or short-term rental income, loss of use, loss of business opportunity, diminution in property value, cost of substitute goods or services, or damages arising from delay.

18.3 Nordhus is not liable for damage to your property arising from Site conditions, drainage, settling, water intrusion, electrical service at your property, or the location you selected for the Unit.

18.4 Nothing in this Section limits liability for gross negligence, willful misconduct, or fraud, or any liability that cannot be limited under applicable law.

18.5 Some states do not allow the exclusion or limitation of certain damages, so parts of this Section may not apply to you.

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nordhus and its owners, employees, and contractors from any claim, demand, loss, damage, fine, penalty, cost, or expense, including reasonable attorney fees, arising from:

a. your use of the Unit, or use by anyone you allow to use it;

b. your breach of these Terms;

c. Site conditions, Site preparation, and the location you selected;

d. your failure to obtain a required permit, inspection, HOA approval, or other approval;

e. any installation not performed by Nordhus;

f. any commercial, rental, or short-term rental use of the Unit.

20. PHOTOGRAPHY AND MARKETING

20.1 You grant Nordhus permission to photograph and video record the Unit and its installed setting, and to use those images and recordings in marketing, advertising, social media, print, and on our website, without compensation to you.

20.2 We will not publish your name, street address, or any identifying detail about your property without your separate written permission, and we will not photograph any identifiable person without their permission.

20.3 You may withdraw this permission for future use by emailing hello@nordhussauna.com. Withdrawal does not require us to recall printed material already produced or distributed.

21. COMMUNICATIONS

21.1 You consent to receive calls, emails, and text messages from Nordhus about your quote, order, delivery, and installation, at the contact information you provide.

21.2 Marketing texts require separate consent and are not a condition of purchase. Message and data rates may apply. Reply STOP to opt out.

21.3 Our Privacy Policy at nordhussauna.com governs how we handle your information.

22. FORCE MAJEURE

Nordhus is not liable for any failure or delay caused by events beyond our reasonable control, including natural disaster, severe weather, wildfire, fire, flood, epidemic, war, terrorism, civil unrest, labor dispute, strike, carrier failure, supplier failure, material shortage, port congestion, tariff or customs action, utility failure, and government order.

23. GOVERNING LAW AND DISPUTES

23.1 These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

23.2 Any dispute arising out of or relating to these Terms or your purchase must be brought exclusively in the state or federal courts located in Boulder County, Colorado. You and Nordhus consent to personal jurisdiction and venue there.

23.3 Before filing suit, you agree to contact us at hello@nordhussauna.com and give us 30 days to attempt to resolve the matter directly.

23.4 In any action arising out of these Terms, the prevailing party is entitled to recover its reasonable attorney fees and costs.

23.5 To the fullest extent permitted by law, you and Nordhus each waive the right to a trial by jury.

23.6 Any claim must be brought within one year after the claim arises, or it is permanently barred, to the fullest extent permitted by law.

24. GENERAL

24.1 Entire agreement. These Terms, your order confirmation, and the Sauna Use Acknowledgment, Assumption of Risk and Release are the entire agreement between you and Nordhus, and replace all prior or contemporaneous discussions, proposals, and representations.

24.2 Amendment. These Terms may be modified only in a writing signed by Nordhus. The version in effect on the date of your order governs your order.

24.3 Severability. If any provision is held unenforceable, the rest remains in force, and the unenforceable provision is modified to the minimum extent needed to make it enforceable.

24.4 No waiver. Our failure to enforce any provision is not a waiver of that provision or any other.

24.5 Assignment. You may not assign this agreement without our written consent. We may assign it in connection with a sale or reorganization of the business.

24.6 Headings are for convenience only.

24.7 Survival. Sections 6, 9, 10, 12, 13, 15, 16, 17, 18, 19, 20, 23, and 24 survive completion of your order.
