Effective Date: July 26, 2026 Version 1.2 Last Updated: October 30, 2026
READ THIS ENTIRE DOCUMENT BEFORE ACCEPTING. IT AFFECTS YOUR LEGAL RIGHTS. IT INCLUDES A RELEASE OF LIABILITY AND A WAIVER OF YOUR RIGHT TO SUE.
1. WHAT THIS DOCUMENT IS
This Acknowledgment, Assumption of Risk and Release (this “Release”) is accepted by the purchaser and owner of a sauna sold or installed by Nordhus (“Nordhus,” “we,” “us,” or “our”). It is part of the Nordhus Terms of Sale, Delivery, Installation and Returns, and is incorporated into that agreement.
Accept this Release using the required agreement checkbox before paying at online checkout. For an offline purchase, accept it in writing before delivery or installation, whichever comes first. Nordhus may decline to complete installation until acceptance is recorded.
2. I UNDERSTAND THE RISKS
I understand that a sauna produces extreme heat, commonly reaching temperatures well above 165 degrees Fahrenheit, and that using a sauna carries an inherent risk of serious injury, illness, permanent disability, and death.
I understand that these risks include, and are not limited to:

b. dehydration and electrolyte imbalance;

n. aggravation of an existing medical condition, known or unknown.
I understand these risks cannot be fully eliminated by instructions, equipment features, warnings, or care.
3. MEDICAL ACKNOWLEDGMENT

I acknowledge that sauna use may be unsafe for a person who:

n. is elderly, or is a young child.
I acknowledge that Nordhus is not a medical provider, has given me no medical advice, has not assessed my fitness to use a sauna, and has made no representation that sauna use is safe or beneficial for me or for anyone in my household.
4. RULES I AGREE TO FOLLOW
I agree that I and every person who uses the sauna at my property will:
a. read the manufacturer operating manual and safety instructions before first use, and follow them;
b. never use the sauna while under the influence of alcohol, cannabis, recreational drugs, or any impairing substance;

l. keep the door unobstructed and openable from the inside at all times;
m. inspect the sauna, heater, stones, wiring, and door hardware regularly, and stop use if anything appears damaged or is not working correctly.
5. MINORS AND OTHER USERS
5.1 I am responsible for every person who uses the sauna at my property, including household members, guests, invitees, contractors, tenants, and anyone who accesses it with or without my permission.
5.2 No person under 18 will use the sauna without the direct, continuous supervision of a responsible adult present in or immediately outside the sauna.
5.3 I will prevent unsupervised access to the sauna, including by using any lockout, child lock, or safety feature available on the control system, and by securing the space where the sauna is located.
5.4 I will inform every user of the risks described in this Release and the rules in Section 4, and I will make the manufacturer manual available to them.
5.5 I accept this Release on my own behalf, and on behalf of my minor children, my household members, my guests, my heirs, my executors, my administrators, and my assigns, to the fullest extent permitted by law.
6. ASSUMPTION OF RISK
I knowingly and voluntarily assume all risks associated with sauna ownership and use, both known and unknown, including risks arising from the ordinary negligence of Nordhus, to the fullest extent permitted by Colorado law.
I accept full responsibility for any injury, illness, disability, death, property damage, or loss suffered by me or by any person using the sauna at my property.
7. RELEASE AND COVENANT NOT TO SUE
7.1 To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue Nordhus and its owners, members, officers, employees, agents, contractors, and subcontractors (the “Released Parties”) from any and all claims, demands, actions, causes of action, liabilities, damages, costs, and expenses, including attorney fees, arising out of or relating to the use of the sauna, whether by me or by any other person, and whether caused in whole or in part by the ordinary negligence of the Released Parties.
7.2 This Release does not apply to gross negligence, willful and wanton misconduct, or fraud by the Released Parties, and does not apply to any claim that cannot be released under applicable law.
7.3 This Release does not release the manufacturer of the sauna or the manufacturer of the heater. Product defect claims are handled through the manufacturer warranty process.
8. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claim, demand, loss, damage, judgment, fine, cost, or expense, including reasonable attorney fees, brought by any person arising out of or relating to the use of the sauna at my property, including claims brought by household members, guests, invitees, tenants, neighbors, and subsequent owners of the property.
9. GENERAL
9.1 This Release is governed by the laws of the State of Colorado. Any action must be brought exclusively in the state or federal courts located in Boulder County, Colorado.
9.2 If any provision of this Release is held unenforceable, the remainder stays in full force, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.
9.3 This Release binds me, my heirs, executors, administrators, and assigns. It survives the sale or transfer of the sauna and the property.
9.4 This Release is part of the Nordhus Terms of Sale, Delivery, Installation and Returns. Together they are the entire agreement between me and Nordhus regarding sauna use and safety.
